All intellectual property rights in the design, content, and arrangement of this website, its text and graphics, software or underlying source code, and all other material on this site are reserved for BSHAA and our technology providers.

We take every reasonable precaution and care in compiling and updating this website. However, we do not make any guarantee (express or implied) concerning the content or operation of this website. We do not guarantee that the use of this website will be uninterrupted or error-free.

Your use of this website and the information contained in it are done so entirely at your own risk. We do not accept any liability for any loss or damages, whether direct or indirect, that you may suffer as a result of your use of this website or your reliance upon the content of this website. This includes but is not limited to, computer service or system failure or interruption, computer viruses or other harmful components, breaches of security, or unauthorised use of the system.

Except as required under law, neither BSHAA nor any of its service providers will be liable for any injury, loss, claim, damage, purely financial losses (including, but not limited to lost profits or lost savings), or indirect or consequential damages of any kind arising out of use of this website.

BSHAA is not responsible for the content of any other websites accessible through any link to be found on the website.

The content of this website, any dispute arising out of the website, and your relationship with BSHAA are governed by English law and shall be subject to the exclusive jurisdiction of the English courts. This site is operated from the UK. If you access this site from outside the UK, you are responsible for compliance with any applicable local laws.

We have the right to change these Terms and Conditions from time to time without prior notice and we will amend the changes on this page.


Members’ Terms and Conditions

These Members’ Terms and Conditions are supplemental to the General Terms and Conditions above and should be read in conjunction with them.

Access to, or use of, some parts of the BSHAA website are password protected and are for the use of members who have joined BSHAA and paid a membership fee. Any rights conferred upon you by these Terms and Conditions shall only come into effect whilst your membership fee is fully paid. Some parts of the site are only accessible by people who have registered with the Society from the website.

As a BSHAA member, you may search, view, copy, and print out materials for your use.

When using information from the website, you accept that the information available on the website is proprietary. Accordingly, you may not divulge such information to a third party in circumstances where they effectively receive some or all of the benefits of a member without paying the applicable membership fee. BSHAA reserves the right to account to you for an additional fee should you seek to contravene this term.

You may not sell or publish in hard copy or electronic format, including on your own internet site, information obtained from the BSHAA website except where otherwise stated.

When you register as a BSHAA member, you will be asked to create an account and provide BSHAA with certain information including a valid email address. You are responsible for maintaining the confidentiality of your member account, including your password and other account access information as applicable. You acknowledge, accept, and agree that you are solely responsible for the form, content, and accuracy of any profile, CV, or material provided within your membership application or subsequently added to the site by you.

As a BSHAA member, you must not disclose your passwords to any third party, and you must take reasonable steps to ensure that no one else uses the BSHAA website in your name. You are liable for activities conducted through your password, whether authorised or not, until you have notified BSHAA of such unauthorised use and BSHAA has cancelled the passwords.

BSHAA reserves the right, to be exercised in its sole discretion, to terminate or restrict your access to this site, or part of this site, at any time and without notice.

BSHAA reserves the right, to be exercised in its sole discretion, to at any time and without notice withdraw or remove from the BSHAA website any information (including forum postings) or link to any site containing information, that appears to BSHAA to be defamatory, obscene, an invasion of privacy, an infringement of any relevant intellectual property right, including copyright, or which is unlawful, contrary to good practice in the relevant industry or otherwise likely to involve BSHAA in civil or criminal liability.

As a BSHAA member, you are solely responsible for any postings you make in the Discussion Forums on the BSHAA website.

BSHAA is not to be considered to be an employer concerning your use of the BSHAA website and BSHAA shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs or responding to the same on the BSHAA website.

BSHAA operates a policy of continuous improvement and welcomes any suggestions or comments in this respect although any comments, suggestions, or submissions (including their subject matter) shall become the exclusive property of BSHAA on its receipt by BSHAA. This may mean that from time to time elements of the website may be withdrawn, removed, altered, or added to.


Membership

BSHAA membership is a personal membership and will move with you if you change your employer.

You may cancel your membership at any time provided that you provide BSHAA with notice of the same. No fees shall be repayable to you in the event of cancellation.

If you cancel your BSHAA membership, your membership information will be removed from the membership directory of the BSHAA website.

Please read the BSHAA Privacy Policy for further information regarding BSHAA’s information gathering and dissemination practices.

Additional Terms of Use for Events

A completed booking form submitted to BSHAA through this website is contractually binding on you irrespective of whether or not payment has been received. Where payment is not made by credit card at the time of booking, payment must be made within 30 days of receipt of an invoice from BSHAA. Any terms sought to be imposed by you in your booking will not form part of the contract.

BSHAA will endeavour to confirm a booking within 3 working days by sending an email to the email address provided on the booking form.

BSHAA is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the event details appearing on our website. If an error or inaccuracy is discovered concerning the advertised prices of the event that you have reserved a place for, we will contact you as soon as possible by email. This will be to inform you of the correct price and to ask you if you wish to continue with the reservation at the amended price or to cancel the reservation altogether. In such circumstances and where payment has already been made, a full refund will be made to the credit/debit card used for the transaction.

Cancellations must be in writing and received before the event by the date set out in the online booking information or booking form. Registrants who do not cancel by that date and who do not attend will be responsible for the full registration fee. Substitutions are allowed at any time but please notify BSHAA in writing of any such substitutions as soon as possible. As BSHAA is a non-profit making organisation, if the substitute is not a BSHAA member, the substitute will be responsible for obtaining BSHAA membership before the commencement of the event or pay the difference between the member price and that charged for a non-member.

BSHAA reserves the right to alter an event venue, if necessary.

In the event BSHAA needs to change the timings of parts of the programme of the event, the booking fees cannot be refunded.

If, for reasons beyond BSHAA’s control, it is necessary to cancel the event or postpone it to another date, the fee paid will be refunded in full providing the original payment request for payment has been made.

BSHAA is not responsible for any loss or damage as a result of a substitution, alteration, postponement, or cancellation of the event due to causes beyond its control including, but without limitation, natural disasters, sabotage, accident, trade or industrial disputes or hostilities. For the avoidance of doubt, BSHAA cannot be held liable for any subsequent or other loss including your accommodation, meals or travel costs, linked to attendance to our event.

BSHAA delegate prices are only available to BSHAA members. If a delegate ceases to be a member between submitting a booking form for an event and the event date, the delegate will need to renew their membership or pay the difference between the member price and the non-member price.

Whilst the event programme is correct at the time of advertising, BSHAA reserves the right to change the details of an event without notice when alterations may be beyond our control.

The views expressed by external speakers are their own and BSHAA disclaims any liability for advice provided by them to delegates.

At certain events photographs and recordings may be taken for promotional purposes.

Additional Terms of Use for Online Training Courses

BSHAA makes every effort to ensure that all information presented in its online courses is correct and current. It is written and reviewed by professionals actively working within the specialty. However, we do not guarantee the accuracy of the information contained in these materials, and reliance on information provided in these materials is solely at your own risk. Every effort has been made to make these materials as complete as possible; however, they may yet contain mistakes, both typographical and substantive. Therefore, this material should be used only as a general guide and not as the ultimate source of information on the audiological profession.

The license you subscribe to when booking a BSHAA online training course is for your individual use only. You are not permitted to share your login details with any other person.

Except to the extent required by any mandatory applicable law, the online courses and the information contained herein are not subject to any warranty or condition, express or implied, including, without limitation, any warranty of merchantability, satisfactory quality, fitness for a particular purpose or use, or non-infringement.

BSHAA does not guarantee the accuracy or completeness of any information contained in the online courses and does not assume any liability or responsibility for any errors or omissions in the information contained in the online courses.


Limitation of Liability

BSHAA shall not be liable for any damages of any kind arising from or in connection with the use of the online courses or the information contained therein, including, without limitation, mistakes, omissions, errors, or defects, even if BSHAA is expressly advised of the possibility of such damages. This is a comprehensive limitation of liability that applies to all damages of any kind, including compensatory, direct, indirect, punitive, special, incidental or consequential damages (including but not limited to damages for lost profits or loss of revenue).
